Real Estate in Montana

The state of Montana has very direct real estate transaction laws that clearly outline the responsibilities of each party. In general terms, the sales agreement can simply be the offer after it has been signed by both parties. An offer that is signed only by the buyer is not considered a completed sales agreement. However, once the sales agreement has been signed by both parties it is considered to be legally binding. All of the clauses and stipulations that were included in the offer become directives of the sales agreement.

Some states allow handshake agreements or verbal understandings to be part of the final sales agreement, provided that they are agreed to by both parties. In Montana, anything that is not in writing at the time the offer becomes the sales agreement is not considered part of the final contract. If the seller verbally agreed to repair the roof of the home but the buyer did not have that stipulation put in the contract that both parties signed, then the seller is not obligated to do any repairs to the roof at all.
