Real Estate in Massachusetts

The commonwealth of Massachusetts has some very particular rules in place when it comes to real estate transactions. For example, all real estate agents are required by law to present all offers they have received to the sellers they are working with. This is a requirement that runs for the duration of the contract that has been signed by the seller and the agent. It is acceptable in Massachusetts for a real estate agent to stop showing a property after the seller has accepted an offer, even if the seller insists on seeing more offers.

Buyers in Massachusetts cannot expect that the submission of an offer that matches the listing price of the property be treated as an offer that must be accepted by the seller. In Massachusetts, a selling price and a listing for a property is only considered an invitation to bid on the purchase of that property. In no way is the listing price considered a binding price for the buyer or the seller. The seller can choose to counteroffer a list price offer at any time.
