The laws of the state of Iowa specifically state that an offer on a real estate transaction is not considered legally binding until it is in writing and signed by both parties. This means that a handshake agreement will hold no significance in an Iowa court of law, which is important information for an Iowa property buyer to know. As with most other states, Iowa state law mandates that the seller provide a disclosure statement to the buyer that outlines any known issues with the property. The buyer has the option of backing out of the agreement if the disclosure gives information that the buyer was not aware of prior to submitting an offer.

In Iowa, it is the responsibility of the buyer to make sure that a property does not have any hazardous materials on it prior to purchasing the property. If a buyer does not take the necessary steps to determine if a property has hazardous materials and an inspector later finds hazardous materials on the property after the transaction is completed, then it is the buyer who will face fines and remediation costs associated with that material.
